Obstruction of Officer (Felony)

It was brought to our attention, through social media, that there would be a possible protest in our City tonight. The post highlighted an incident involving Officer Van Alstine and Shanita Maeberry.

The following incident was captured on body-worn and in-car cameras. See below for video links.

On 11/09/16, at approximately 10:00 PM, Officer Van Alstine observed a Honda Accord waiting at the private drive of the Starbucks at 10800 Alpharetta Hwy. Officer Van Alstine immediately detected the odor of marijuana coming from the open window of the vehicle and observed, what appeared to be, one of the occupants smoking. Officer Van Alstine pulled over the vehicle at the Shell gas station located at 10761 Alpharetta Hwy. Upon approaching the vehicle, Officer Van Alstine continued to smell marijuana. The passenger, Shanita Maeberry, admitted to smoking marijuana. Officer Van Alstine asked both of the occupants to exit the vehicle. Additional marijuana was located inside the vehicle. Officer Van Alstine attempted to place Maeberry under arrest, but she began to resist arrest by pulling away from him.

Maeberry was instructed multiple times to stop, but she continued to resist by flailing her arms at the officers and punching Officer Van Alstine in his face. Officer Van Alstine subsequently struck Maeberry once in her face to gain control. The Officers immediately deescalated their use of force.

Maeberry advised officers that her mouth hurt.The officers requested an ambulance. Rural Metro Ambulance service responded to the scene and assessed Maeberry advising her that she had superficial injuries. Maeberry was transported to the Roswell Detention Center. Upon transfer to the Fulton County Jail, Maeberry complained of mouth pain, and she was refused intake by Fulton County. The Roswell Police Department transported Maeberry to a local hospital where they determined that her jaw was broken. Her injuries were attended to.

Maeberry was charged with possession of marijuana and felony obstruction of an officer.
